What is a Variance? Simply put, a variance, if granted, allows something to happen that is otherwise prohibited by the Zoning Ordinance.
Everyone has the right to apply for a variance from the Zoning Board of Appeals. Note the key word in the Board’s title… “Appeals.”
Technically, the applicant is making an appeal to this particular board to overturn an action by the Code Enforcement Officer, which is usually the denial of a building permit.
The Code Officer only has the ability to issue building permits if the proposed work meets the minimum requirements of the Town’s Zoning Ordinance.
