Town of Webb board authorizes legal action against owners of non-compliant property

Following a brief discussion at the Town of Webb Board Meeting on September 13, the Board voted unanimously to authorize and direct Supervisor Robert Moore and Town Attorney Richard Frye to take action against a property owner for failure to comply with the local ordinance and state fire prevention and building code.

The action involves commencing with a legal proceeding in New York State Supreme Court of Herkimer County.

The offending property is located on Grove Trail and owned by Mark and Therese Frateshi , according to Attorney Frye.

The proceedings were prompted following months-long complaints to the Webb Code Enforcement Office by area property owners.

It was alleged that the Frateshis were violating local ordinance and state code by using a bunkhouse as a residence.

Following an investigation by Town of Webb Code Enforcement Officer Andy Getty, a notice of violation was issued directing the property owners to cease and requiring them to correct the violations within thirty days.

Subsequently the Town of Webb Code Enforcement office has determined that corrections have not been made, according to Frye.

The passage of the resolution by the Town Board allows the immediate initiation of legal action, Frye said.
